It's not because gummy manufacturers are careless — it's because gummies are, chemically speaking, a genuinely harder product to get right than flower or a simple tincture. Here's why, and what actually fixes it.
The Core Problem: Cannabinoids and Gummy Bases Don't Mix Naturally
THC and CBD are fat-soluble compounds. A gummy base is primarily water, sugar, and gelatin or pectin — an environment cannabinoids don't naturally want to distribute evenly through. Left to simple mixing, cannabinoid oil tends to clump, pool, or separate rather than spreading uniformly through the batch. The result is a product where some gummies in a batch are under-potent, others are over-potent, and the average might look fine on paper while individual pieces don't.
This is why homogeneity testing exists as its own mandatory panel for edibles in Michigan, separate from the potency panel — a batch can have a "correct" average potency and still fail because the distribution across individual pieces is inconsistent.
The Most Common Failure Points
Inadequate emulsification. If the cannabinoid oil isn't properly emulsified into the water-based mixture before it's poured into molds, you get exactly the clumping problem described above. This is the single most common root cause of homogeneity failures.
Pouring order and temperature. Gummy mixtures are poured at a specific temperature window. Pour too hot and cannabinoids can degrade or the emulsion can break; pour too cool and the mixture won't flow evenly into every mold cavity, leading to inconsistent fill.
Batch size scaling problems. A process that produces consistent results at a 5-liter batch size doesn't always scale linearly to 50 liters. Mixing time, cooling rate, and emulsifier ratios that worked at a small scale often need real re-validation at production scale — not just a proportional multiplication of ingredient amounts.
Settling during the pour. If there's any delay between mixing and pouring into molds, cannabinoid oil can begin to separate out again before the mixture sets, especially if the emulsion wasn't stable to begin with.
Insufficient or non-representative sampling. Even a genuinely well-made batch can appear to fail if the lab (or the processor's internal QC) only samples from one location in the batch — say, the first few gummies poured, rather than a proper multi-point sample across the full production run.
What Actually Fixes This
Invest in a real emulsification system. Whether that's a high-shear mixer, a purpose-built emulsifier, or a nano-emulsion technology, the goal is the same: get cannabinoid oil suspended as consistently small, evenly distributed droplets before it ever reaches the mold. This single step resolves more homogeneity failures than any other change a processor can make.
Validate your process at actual production scale, not just at a small test batch. If you've scaled up recently, treat that as a new process that needs its own validation runs and test results before you rely on it for retail batches.
Build in multi-point internal sampling before you ever send a batch to the lab. Pull from the beginning, middle, and end of a production run and test internally if you have the capability. Catching an inconsistent batch before submission saves the cost, time, and quarantine delay of a formal failure.
Keep detailed batch records — mixing time and temperature, emulsifier lot numbers, pour temperature, and mold-fill order. When a batch does fail, these records are what let you actually diagnose the cause instead of guessing.
Talk to your lab about your process, not just your results. A lab that only reports pass/fail is giving you half the picture. A lab that will discuss your emulsification method, your sampling plan, and your batch records with you is helping you actually prevent the next failure, not just document it.
The Cost of Getting This Wrong
A failed batch isn't just the retest fee. It's the production time already sunk into that batch, the delay to your retail commitments, and — depending on volume — real destroyed product if remediation isn't an option under CRA rules. For most edible processors, the emulsification and validation investment pays for itself the first time it prevents a failed production run.
